The general terms of sale are available online on a purely informative basis and may not be contractual. 

Made With Love Property Management represented by Mrs. Joannie SALVI and Mr David Hocquet is a servicing company which proposes services of intendance, maintenance, monitoring of goods and rental assistance. 

One understands by CUSTOMER the final customer or beneficiary of the services of Made With Love Property Management. 

One understands by SERVICES the services of intendance, maintenance, monitoring and/or rental assistance ensured by Made With Love Property Management. One understands by RESIDENCE the real estate, as main home or secondary, of the CUSTOMER. 

1 – Application of the general terms of sale 

1.1 The present general terms of sale are systematically transmitted to each CUSTOMER prior to any placing of order. Consequently, and except contrary convention, the fact of placing order carries whole adhesion and without reserve of the CUSTOMER to the present general terms of sale.

1.2 The present general terms of sale are likely to be modified without notice in the event of evolution of the commercial, social and tax legislation. A notification of the modifications will be addressed to the CUSTOMER as soon as possible. 

2 – Services 

2.1 The services of Made With Love Property Management are accessible to individuals or companies by the subscription to a basic fixed monthly price named Key Package and/or by the subscription to “tailor made services“. 

2.2 Key Package offer following services: 

– Keeping and giving the keys of the RESIDENCE to the owners. 

– Monthly mail check. 

– Monthly general inspection, one hour maximum, RESIDENCE: checking for leaks or any type of damages, theft traces, the functioning of specific appliances like, air-conditioning, water-heating systems, electricity, etc… of the RESIDENCE. 

2.3 This Key Package can be possibly supplemented by the following services: 

– Full cleaning (full washing of all the parts of the residence: vacuum cleaner, floor water cleaning, bathrooms and mirrors, dust collection, washing of cloths and towels) after the departure of the CUSTOMER, the friends or tenants of the CUSTOMER (does not include the expenses of laundry or dry cleaning). 

– Purchase and delivery of food and non-food products (maximum 72hours before the arrival of the CUSTOMER by e-mail, invoicing of the service + the amount of the shopping).

– Reception of goods/orders in the RESIDENCE of the CUSTOMER.

– Organisation and/or supervision of renovation works, normal do-it-yourself renovations that do not require particular technical skills nor licences or administrative licences. For major renovations or transformations Made With Love Property Management will propose you professional companies hired through us.

– Assisting and representing the CUSTOMER with the residence general meetings.

– Inspection of the RESIDENCE at the request of the CUSTOMER apart from the monthly inspections contained in Key Package.

 

– Loan of equipment of childcare (baby bed – high chair – change cushion – adapted Dishes) – Caution when using the package 100 € given to Made With Love Property Management as of the handing-over of the keys of the RESIDENCE. This caution will be completely refunded the day of your departure, if no damages were to be seen by Made With Love Property Management.

– Loan Kids Fun Package at the request of the customer – Caution when using the package of 30 € given to Made With Love Property Management as of the handing-over of the keys of the RESIDENCE. This caution will be completely refunded the day of your departure, if no damages were to be seen by Made With Love Property Management.

– Reservation of restaurants, Green Fee, beach club, or any service not requiring legal licences.

 

– Installation and/or reparation of computer material or audio-visual (management of the installation). 

All these services will be under the pricing per hour grid of Made With Love Property Management. For reasons of material organisation (road time and kilometers + optimization of our planning), any service has a minimum duration of an hour, after this the service will be counted in half hours. Any started service is due. 

The Key Package is a yearly package. 

3 – Conditions on the execution of the services 

3.1 The CUSTOMER will totally receive the services and rates included in his formula Key Package. In the event of not using totally or only partially these services, no refunding could be required by the CUSTOMER. The services are carried out at the days and hours agreed upon with the customer. It is however specified that the subscription for its formula (Key Package and services) gives the CUSTOMER a right to the services of Made With Love Property Management from 9:00 to 20:00 Monday to Friday, for the execution of the services in his subscription. The services carried out the Saturdays, Sundays, night shifts (between 20:00 and 9:00) and bank holidays, are raised of 50% on the basis of price, mentioned in the pricing per hour grid, of the services, which are defined in the 2.3. 

3.2 Any request for specific service, which would not have been chosen by the CUSTOMER within the framework of his formula Key Package, must be the object of a preliminary request by e-mail, which will have to be received by Made With Love Property Management at least 72 hours in advance. Made With Love Property Management will inform, in the 24 hours of the reception of the request, the CUSTOMER of its possibility or not of carrying out the required service.

4 – Outsourcing 

Made With Love can us the services of other companies, this for the complete or partial execution of the offered services.

In case of outsourcing, Made With Love stays responsable of the correct execution of the contract and is the only one authorised to bill the CUSTOMER.

5 – Practical Methods, duration and commitment of the parties 

5.1 Any service required by the CUSTOMER will cause the establishment of a preliminary quotation; which will be accompanied by the price per hour grid of Made With Love Property Management. The quotations are free and the contract is formed as of the acceptance of the quotation by the CUSTOMER via e-mail return or signature of the initial quotation. The CUSTOMER will not be able to cancel his order after confirmation. All the services with are payable at the reception of the invoice. 

5.2 As described into 2.1, the Key Package of Made With Love Property Management is carried out on the basis of fixed monthly price for a 12 months duration. One trial period of 1 month is granted to the CUSTOMER. The subscription also includes, an automatic re-conduction with the same conditions and for the same duration. The CUSTOMER can terminate its contract by addressing us, three months before the expiration date of the contract, with registered letter. In the event of cancellation, the CUSTOMER remains indebted with the amounts of the services remaining to be run and of all the invoices in progress. We will not be carry out to any refunding. 

5.3 The Key Package contract is payable quarterly and at the beginning of each period. A guarantee equivalent to 3 months of formula Key Package will be transferred to Made With Love Property Management as of the commitment of the CUSTOMER to subscribe the mentioned formula. This guarantee will be restored completely to the CUSTOMER only if the conditions of breach of contract answer the above mentioned rules as in point 5.2 

6 – Obligations of the parties 

6.1 Made With Love Property Management is committed to take to the execution of the services all its care and respecting the standards and procedures in force with the CUSTOMER.

 

6.2 The CUSTOMER will thus give to Made With Love Property Management the day of the contract signature, the material giving access to the RESIDENCE, such as a double of the keys, alarm code, remote control or code for the gate, the and up to date contact such as telephone number, e-mail, official address. The CUSTOMER commits himself to do everything to allow Made With Love Property Management to carry out the services and to finalise the services within the time defined by the contract which binds the two parties.

7 – Price and payment of the services 

7.1 The services are carried out at the prices and conditions mentioned in the quotation. The prices in euros and without VAT. 

7.2 The invoicing corresponds to the services carried out by Made With Love Property Management, which mean on the one hand services rising from the formula chosen by the CUSTOMER (Key Package) like, on the other hand, the specific complementary services possibly requested by the customer. The services will be invoiced according to the methods of the quotation (annual, quarterly, monthly, etc). The payment will have to be carried out by bank transfer as of reception of the invoice by the CUSTOMER. 

7.3 Any money due at the payement limit will involve: 

– the payment of post maturity interest at the rate equal to once and half legal interest rate, in accordance with the applicable regulation. 

– Refunding with Made With Love Property Management of the bank charges which it would have to support because of a rejection of the taking away or transfer, 

– Immediate current liability of all the sums remaining due (the whole of the emitted invoices fallen or not fallen), 

– The suspension or the cancellation of any order and service in progress. 

– Any invoice recovered by contentious way will be raised of an allowance fixed contractually at 15% (fifteen percent) of the sums due with a minimum of 100 € (hundred euros). 

7.4 Any request for services formulated by a tenant or friends during a renting of your RESIDENCE will have to be regulated cash by the them. In the contrary case, the whole of the undue sums will be the responsibility of the owner, during the in progress. 

The Owner (CUSTOMER) will be legally responsible for his tenants as for the services carried out by Made With Love Property Management for all the duration of their stay. 

The owner (CUSTOMER) commits himself making available of his tenants, this document. 

8 – Personal data

By signing the contract, the Customer has to provide Made With Love with personal data. The Customer certifies to provide only fair and accurate information.

Made With Love is responsible for the processing of personal data collected under the contract. In this context, Made With Love guarantees to comply with all laws and regulations relating to the protection of personal data.

The personal data transmitted is processed by Made With Love in order to allow the Customer to benefit from the services in the most complete way possible. The Customer expressly authorises Made With Love to communicate the data collected to the subcontractor(s) to which it would call for the performance of the services to the extent that such communication is necessary to the subcontractor for the execution of those services. Without prejudice to the foregoing, Made With Love undertakes not to communicate the personal data of the Customer to any other third party without the prior and express consent of the Customer.

The Customer has the right to access, rectify and delete data concerning them. The Customer may ask for the rectification, completion, clarification, updating or erasure of information concerning him.

Customer data is kept and archived confidentially by Made With Love or any Data Subcontractor mandated by Made With Love, for a period of up to 10 years after completion of the Agreement.

 

9 – Insurances and responsibilities 

9.1 Made With Love Property Management is titular of a multi risk insurance policy. 

 

9.2 The CUSTOMER takes responsibility for his insurance on all risks and direct or indirect damage being able to affect the whole of all his properties and installations and declares that it is and will be, covered by all insurances policies in conformity with the uses on the matter, in particular taking into consideration his civil responsibility with regard to the thirds during the entire duration of the the contract with Made With Love Property Management.

9.3 The responsibility of Made With Love Property Management could be committed only in the event of its fault and its insurance is limited to the refunding of the goods which could be deteriorated by Made With Love Property Management. Any damage will have to be announced by telephone or written, in the 48 hours following the service concerned. 

9.4 In no case the responsibility of Made With Love Property Management could be induced when there are fault, negligence, omission or failure of the CUSTOMER, major events or incidents independent of the will of Made With Love Property Management such as illness of a third party, social disturbances, public and natural calamities, fault, negligence or omission of a third party on whom Made With Love Property Management does not have any supervisory power or monitoring. 

10 – Legal and juridiction 

10.1 The present general terms of sale as all the services which are aimed here are under the controls of the Spanish legislation. 

10.2 Any dispute or litigation relating to the interpretation and the execution of these general terms of sale will be carried in front of the courts of Marbella.
